If both parties to the litigation have agreed to settle and have prepared an agreement to that effect, the court will hold off until the agreement has been legally certified and shown in court, so as to ensure that the claimants’ rights are protected and that no one is deceived.
The defendant is not obligated to engage in online dispute resolution and may opt-out. If the defendant does not accept the plaintiff’s offer to use ODR, both plaintiff and the defendant must present in court on the appointed date and time.
If the case has been settled between both the parties but the Defendant doesn’t do what they agreed to do, the respective court of jurisdiction can be approached with regards to implementation/enforcement of the Settlement agreement between the parties.
